1. Acceptance of Terms

By accessing or using Flirton.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Eligibility & Age Requirement

By using Flirton.ai, you represent and warrant that:

• You are at least 18 years of age or the age of majority in your jurisdiction
• You have the legal capacity to enter into binding contracts
• You are not prohibited from using the Service under applicable laws
• You will not allow minors to access your account
• You understand that the Service may contain explicit adult content

We reserve the right to request proof of age at any time. Accounts found to be used by minors will be immediately and permanently terminated without refund.

3. Description of Service

Flirton.ai is an AI-powered chat platform that allows users to create, customize, and interact with fictional AI characters. The Service includes:

• Character Creation: Create custom AI characters with unique personalities, appearances, and scenarios
• Real-Time Chat: Engage in text-based conversations with AI characters powered by advanced language models
• Image Sharing: Send and receive images in chats (Premium/Unlimited plans)
• Discovery: Browse and interact with publicly available characters created by other users
• NSFW Content: Optional access to adult-oriented content with explicit opt-in required

Flirton.ai offers three subscription tiers:

• Free: 20 messages/day, 3 characters maximum, text-only
• Premium ($9.99/month): 500 messages/day, 50 characters, 4 images per message
• Unlimited ($24.99/month): Unlimited messages, unlimited characters, unlimited images

4. Account Registration

To use Flirton.ai, you must create an account by providing accurate, current, and complete information. You agree to:

• Provide truthful information during registration
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized use of your account
• Not share, sell, or transfer your account to another person
• Create only one account per person

You are solely responsible for all activities that occur under your account.

5. NSFW Content & User Responsibility

By enabling NSFW content, you acknowledge and agree that:

• You are of legal age (18+) in your jurisdiction to view adult content
• You will not be offended by explicit, sexual, or suggestive material
• All AI characters are entirely fictional and do not represent real people
• AI-generated responses may be unpredictable and potentially offensive
• You use NSFW features at your own risk and discretion
• You will not use the Service to generate illegal content (see Section 6)

You can disable NSFW content at any time in your account settings. When disabled, NSFW-marked characters and content will be automatically filtered from your experience.

Important: Even with content moderation systems in place, AI may occasionally generate inappropriate responses. Flirton.ai is not responsible for the nature or tone of AI-generated content.

6. Prohibited Conduct

You agree NOT to use Flirton.ai for any of the following purposes:

Additionally, the following are prohibited:

• Harassment, bullying, doxxing, or stalking of other users
• Hate speech, discrimination, or incitement of violence
• Spam, unsolicited advertising, or commercial solicitation
• Impersonation of real people, including public figures
• Copyright infringement or intellectual property violations
• Scraping, data mining, or automated access (bots)
• Attempts to hack, exploit, or disrupt the Service
• Sharing or selling accounts
• Using the Service for fraudulent or deceptive purposes

Violations may result in warnings, suspension, or permanent account termination without refund. Severe violations may be reported to law enforcement.

Note on Private Content: Private characters and chats are not actively moderated, but users remain fully responsible for ensuring private content complies with all applicable laws. Illegal content (especially CSAM) is prohibited regardless of visibility and may be reported to authorities.

7. AI-Generated Content Disclaimer

You acknowledge and agree that:

• AI characters are entirely fictional and do not represent real people
• AI responses may contain factual errors, hallucinations, or fabricated information
• AI-generated content should NOT be considered professional advice (medical, legal, financial, etc.)
• The AI may generate offensive, biased, or inappropriate content despite filtering
• Flirton.ai is not responsible for decisions made based on AI conversations
• You will independently verify any critical information before acting on it

Flirton.ai does not endorse, verify, or assume responsibility for any AI-generated content. The views expressed by AI characters do not reflect the opinions of Flirton.ai.

8. Intellectual Property

Flirton.ai Platform: All intellectual property rights in the Flirton.ai platform, including software, design, trademarks, and technologies, are owned by Flirton.ai or its licensors.

User-Created Content: You retain ownership of characters, descriptions, and other content you create. By creating content on Flirton.ai, you grant us a non-exclusive, worldwide, royalty-free license to:

• Display your public characters to other users
• Use your content to improve and train our AI systems
• Store and process your content to provide the Service

AI-Generated Outputs: Ownership of AI-generated conversational content is a legally unsettled area. You and Flirton.ai share rights to AI outputs, with you retaining the right to use them as you see fit, subject to these Terms.

You may not upload copyrighted material (images, character designs, etc.) without permission. See our Content Policy for copyright infringement procedures.

9. Payments & Subscriptions

Flirton.ai offers paid subscription plans processed securely through Stripe. By subscribing, you agree to:

• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle
• Payment Authorization: You authorize us to charge your payment method
• Price Changes: We may modify prices with 30 days' notice via email
• Taxes: Prices do not include applicable taxes (VAT, sales tax, etc.)

You can cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period, with no refunds for partial periods.

10. Account Termination

By You: You may delete your account at any time through account settings or by contacting support at support@flirton.ai. Upon deletion:

• Your account will be deactivated immediately
• All personal data will be permanently deleted within 30 days
• Characters, messages, and content will be removed
• No refunds will be issued for remaining subscription time

By Flirton.ai: We reserve the right to suspend or terminate your account immediately, without notice or liability, if you:

• Violate these Terms of Service
• Engage in prohibited conduct (see Section 6)
• Are discovered to be underage
• Abuse the Service or other users
• Engage in fraudulent payment activity

Accounts terminated for violations are not eligible for refunds. Certain provisions of these Terms (liability limitations, indemnification, governing law) survive termination.

11. Limitation of Liability

Flirton.ai provides the Service on an "AS IS" and "AS AVAILABLE" basis, with NO WARRANTIES of any kind, express or implied.

We specifically disclaim warranties regarding:

• Accuracy, reliability, or quality of AI-generated content
• Uninterrupted or error-free operation
• Fitness for any particular purpose
• Security against unauthorized access or data breaches

To the maximum extent permitted by law, Flirton.ai shall NOT be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Emotional distress or psychological harm
• Damages resulting from reliance on AI-generated content
• User-generated content or interactions between users
• Third-party services (Stripe, Clerk, x.ai, etc.)

Maximum Liability: In any case, Flirton.ai's total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

12. Privacy & Data Protection

Your privacy is important to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Flirton.ai complies with applicable data protection laws, including GDPR (EU) and CCPA (California). You have rights regarding your personal data, including:

• Access: Request a copy of your data
• Rectification: Correct inaccurate information
• Erasure: Delete your account and data
• Portability: Export your data in a machine-readable format
• Opt-Out: Unsubscribe from marketing communications

13. Changes to Terms

Flirton.ai reserves the right to modify these Terms at any time. We will notify users of material changes by:

• Sending an email to your registered address
• Posting a notice on the platform
• Updating the "Last updated" date at the top of this page

Changes take effect 30 days after notification (or immediately for legal compliance). Continued use of the Service after changes constitutes acceptance.

If you do not agree to modified Terms, you must stop using the Service and may delete your account.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of France, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of Flirton.ai shall be subject to the exclusive jurisdiction of the courts of France, unless mandatory consumer protection laws in your country require otherwise.

For EU Users: If you are a consumer residing in the EU, you may also bring claims in your country of residence, and nothing in these Terms affects your statutory consumer rights.
